1. Acceptance of terms

By using Yadink ("the Service", "we", "us"), creating an account or making a purchase, you agree to these Terms & Conditions. If you do not agree, do not use the Service. Yadink is operated by Dzeal Private Limited, India.

2. Eligibility

You must be at least 18 years old to create an account or buy Pro. Younger users may use the free editor, which needs no account, with the involvement of a parent, guardian or teacher.

3. The Service

Yadink lets you write text on your photos, or in a border around them, in a choice of styles, and save the result as an image. The editor runs inside your browser; your photos and text are not uploaded to us. Free pictures carry a small "yadink.dzealai.com" mark; Pro pictures do not.

4. Your content

• You keep all rights to your photos, your text and the pictures you make.
• You are responsible for what you write and how you use your pictures. Do not use Yadink to create content that is unlawful, defamatory, hateful, harassing, sexual, or that uses other people's photos or private information without the rights or consent you need.
• Because we never receive your photos or text, we do not review them and are not responsible for them.

5. Accounts

• Keep your login details confidential. You are responsible for activity under your account.
• Give accurate information, including a valid email address, used for verification, account recovery, purchase confirmations and account deletion.
• An account is needed only to buy or receive Pro.

6. Yadink Pro

• Pro is a one-time purchase that unlocks the Pro features described on our Pro page for the account that bought it, for as long as the Service runs. It does not renew and is not a subscription.
• Our promise: Pro includes every Pro feature that works on your device, now and in future updates. We will not remove a feature from Pro or turn Pro into a subscription.
• Future features that store things online for you and cost us money each time they are used (for example voice notes behind a QR code, or shared family cards) may be offered separately, as described on the Pro page.
• Personal licence. Pro is for personal use by the account holder only. Do not share your login. An account can be signed in on up to 3 devices at once; signing in on another device signs out the one used longest ago.
• Organisations. Businesses, studios, schools and other organisations where more than one person uses Yadink for work need a business licence. Please contact us. We may suspend Pro on accounts that are clearly shared by an organisation, after first contacting the account holder.
• Pro has no cash value and cannot be transferred or resold.
• Codes and free Pro. Discount codes apply only as stated for each code and cannot be combined. Free Pro (from a code or given by us) is promotional, lasts for the period stated, and may be withdrawn if obtained by misuse.

7. Payments and taxes

• Payments are processed by Razorpay. We do not store your card or bank details.
• Prices are in Indian rupees (INR), including GST, for customers billed in India, and in US dollars (USD) elsewhere, based on the billing country you give.
• Bank, card or currency conversion charges are payable by you.
• Invoices can be viewed and saved from your account page.
• Pro is non-refundable once unlocked, except as set out in our Refund & Cancellation Policy.

8. Acceptable use

You must not attempt to bypass the Pro check, the device limit or the free mark, share your account, access another user's account, overload or disrupt the Service, or copy, scrape or resell the Service.

9. Intellectual property

The Service, including its software, design and branding, belongs to us or our licensors. Fonts and other open-source components are used under their own licences.

10. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind. See our Disclaimer.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or loss of profits, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the twelve (12) months before the claim.

12. Indemnity

You agree to indemnify us against claims, damages and expenses arising from your content, your pictures, your use of the Service, or your breach of these Terms.

13. Suspension and termination

We may suspend or close accounts that breach these Terms. You may delete your account at any time from your account page. Deleting an account ends Pro on it, without refund.

14. Discontinuation

If we decide to discontinue Yadink, we will give at least 30 days' notice by email and on the site and stop new purchases from the date of notice. Where we can, we will offer Pro buyers a way to keep using the editor offline.

15. Changes, law and contact

We may update these Terms; material changes are shown by the "Last updated" date. These Terms are governed by the laws of India, with exclusive jurisdiction of the courts in Mumbai. If any provision is unenforceable, the rest remain in effect. These Terms, with our Privacy Policy, Pro page, Refund & Cancellation Policy and Disclaimer, are the entire agreement between you and us.
